  • how many members need to be in a band to use the band name?

    I band I like has reformed recently. but it only contains the original two guitarists, one who is now going to be the singer.
    the original singer died years ago. the original drummer isn't liked by the other original members.

    so how many members need to be in a band to reform?
    I know bands like Napalm death have no original members as people have left and been replaced over the years.

      The drummer will either sue the guitarists for the name or start his own band under the same name and get sued by the guitarists. The case will be settled out of court for a considerable compensation, after which one of the parties will alter their name just slightly.

        My guess is that the answer is in 'the legals' that were done when the band first got going properly. It is the kind of thing that would be sensible to deal with in the relevant documents.

        Clearly, no sensible person would be a part of a band that wasn't on a sound legal footing.

          To avoid problems , they should relaunch the band under the name "The (insert original band name) Experience".

          However, that sounds a bit like a tribute band, so the original members' names should be highlighted, too, resulting in "(1st guitarist) and (2nd guitarist)'s (original band name) Experience"

              Those guys in Napalm Death are having a bit of a lend, don't you think?

              They should disband and reform with a different name. Something like 'Panda Hamlet' would be appropriate.

                Dr Feelgood haven't had an original member for over 20 years, but they are still going.

                      I think Heraclitus must have been addressing this very issue when he said 'no man ever steps in the same river twice, for it's not the same river and he's not the same man.'

                      By my maths there have been around 73 members of the group Santana over the years. That's quite some turnover.

                              And apparently Gene Loves Jezebel, those also-ran goth rockers, split up in two when the twin brothers Aston fell out in the nineties, and have existed in parallell versions since, suing each other. Even sillier than the Gallaghers.
